General Terms and Conditions of Sale

“Magic-Home” Software – INITIA SRL

1. Purpose

These General Terms and Conditions of Sale aim to define the terms for selling user licenses of the “Magic-Home” software, property of INITIA SRL.

2. User License

The purchase of a license grants the client a personal, non-exclusive, non-transferable, and revocable right to use the “Magic-Home” software for a renewable period of 36 months. Any sub-licensing or resale is prohibited.

3. Prices and Payments

The standard rate is €17 VAT included per month, billed every three months and in advance.

4. Delivery and Access

The software is accessible in digital form after payment validation. No physical shipment is planned.

5. Technical Support

Technical support is available throughout the validity period of the license, according to terms specified in the contract or via the email address support@magic-home.immo

6. Client’s Obligations

The client undertakes to use the software in accordance with its intended purpose, without infringing upon third-party rights, nor seeking to circumvent the software’s technical or legal restrictions.

7. Termination

In the event of a material breach of the GTCs, INITIA SRL reserves the right to terminate the license with immediate effect.

8. Liability

INITIA SRL shall not be liable for damages resulting from misuse of the software. Its liability is limited to the amount paid by the client during the license validity time.

9. Personal Data and Confidentiality

Data exchanged in connection with the use of the software are processed confidentially and are never shared without consent, except where legally required.

10. Governing Law and Jurisdiction

These General Terms and Conditions of Sale are governed by Belgian law. Any dispute shall fall under the exclusive jurisdiction of the courts of Liège.
